That's a bit of a general problem for ASoC. It'd be possible to deal with it by passing in configuration from the machine driver which selects which controls are registered or which uses the ability to disable controls that you've got in your unstable tree.
Normally it's not a big deal since end users never see the ALSA controls directly but interact with a device-specific UI instead.
